Government asked Supreme Court to rule on warrantless GPS tracking

On April 15, 2011, the Obama administration petitioned the US Supreme Court for certiorari in the case of US v. Maynard in an appeal from an August 2010 decision in the US Court of Appeals for the District of Columbia Circuit. Specifically, the government appealed the lower court’s determination that prolonged use of GPS to monitor vehicles by law enforcement violates Fourth Amendment protections against unreasonable searches and seizures. The court ultimately denied certiorari in the case. However, in January 2012, the US Supreme Court ruled in US v. Jones that the attachment of a GPS device to a car constitutes a search under the Fourth Amendment.
