GUANTANAMO TRIBUNAL – Khadr documents confiscated, defence says

GUANTANAMO BAY, CUBA – Pretrial motions in Omar Khadr’s U.S. military tribunal are set to resume tomorrow amid new allegations that the prosecution is hindering his defence team.

Mr. Khadr’s U.S. military defence lawyer, Lieutenant-Commander Bill Kuebler, told reporters yesterday that the Joint Task Force – the military branch responsible for the Guantanamo detainee camps where Mr. Khadr is held – had recently confiscated hundreds of pages of attorney-client documents in Mr. Khadr’s possession. When Mr. Khadr, 21, asked for the documents “he was brought an empty box,” Cdr. Kuebler said.

JTF officials refused to comment on the allegations, which may come up in court tomorrow.

The allegation is the friction point in what has been a deeply combative process between defence and prosecution lawyers handling the case of Mr. Khadr, who faces several charges before a military commission, including murder. The prosecution has openly objected to some statements the defence has made to the media, while defence lawyers say it is virtually impossible to mount Mr. Khadr’s defence because the prosecution is withholding evidence.
